These terms govern your use of the Brionic Security website and describe our website and e-commerce care & monitoring plans and the service levels (SLA) that apply to update requests. Specific scope, plan inclusions, and pricing are confirmed in a written service agreement.

By using this website, you agree to these terms.
2. Our services
Brionic Security designs and builds fast, secure corporate websites and e-commerce stores, and provides ongoing care, monitoring, and security for them. The details, scope, and pricing of any engagement are agreed in a separate service agreement; information on this site is for general guidance.
3. Web maintenance plans
We keep your website or online store online, up to date, backed up, and secure with an ongoing care plan. Choose the level that fits your site — every plan can be tailored to your needs. Pricing is quoted per site; contact us for a quote.

The following response and turnaround targets apply to clients on an active care plan. Business hours are Monday–Friday, excluding U.S. public holidays. Turnaround begins once we have the information and access needed to complete the request.

Critical and security issues are covered by 24/7 monitoring and take priority over standard requests. Complex requests may take longer; we'll always let you know the expected timeline up front.
5. Scope & exclusions
Care plans cover the maintenance, monitoring, updates, and support described in your plan. Work outside that scope — such as new features, redesigns, or third-party services — is quoted separately. We are not responsible for issues caused by third-party services, code, or changes made by others.
6. Billing, cancellation & your data
Recurring billing
Care plans are billed on a recurring monthly basis as set out in your service agreement. You may upgrade or downgrade with reasonable notice; changes take effect from your next billing cycle.
Cancelling a plan
To cancel a plan, email [email protected] requesting cancellation at least 15 days before your next monthly recurring charge. If your request reaches us fewer than 15 days before that charge, you will be billed for the next billing cycle, and your plan will be cancelled at the end of that cycle.
Your data after cancellation
For plans that include email, any email accounts, mailboxes, and backups we generated for you will be permanently deleted after cancellation, with no recovery option — unless you request a copy before your plan ends. If you ask us to retain or export this data, an additional fee applies based on the size of the backups and the number of email accounts, determined on a case-by-case basis. Please contact us before cancelling if you need your data.
7. Client responsibilities
You agree to:
- Provide accurate, lawful, and complete information and materials;
- Supply the content, files, approvals, and access we need to do the work in a timely manner;
- Keep your own copies of important content, files, and credentials;
- Maintain the security of any accounts and passwords you control; and
- Ensure any materials you provide (text, images, logos, code) do not infringe third-party rights and comply with applicable law.
Delays or issues caused by missing information, access, or third-party approvals are not our responsibility.
8. No guarantees & security disclaimer
We use commercially reasonable efforts and industry best practices, but we do not guarantee specific results, uninterrupted or error-free operation, particular search-engine rankings, traffic, sales, or 100% uptime. Monitoring, updates, and security measures substantially reduce risk but cannot eliminate it: no website, server, or system can be made completely secure, and we do not warrant that your site will be free from vulnerabilities, malware, breaches, data loss, or downtime. You are responsible for maintaining independent backups of critical data. Uptime and performance depend on third-party hosting and networks outside our control.
9. Third-party services
Our work may rely on or integrate third-party products and providers — for example hosting, domain registrars, CDNs, email providers, plugins, themes, payment processors, and analytics. We are not responsible for the availability, performance, security, acts, or omissions of third parties, or for changes they make to their services, pricing, or terms. Third-party products are governed by their own terms and licenses.
10. Acceptable use
You agree to use this website and our services lawfully and not to disrupt, misuse, reverse-engineer, or attempt to gain unauthorized access to them, and not to use them to store or transmit unlawful, infringing, or harmful material.
11. Intellectual property & content
Except for materials you provide, all content on this website is owned by Brionic Security LLC. Ownership of the custom deliverables we create for you transfers to you upon full payment; third-party components (such as plugins, themes, fonts, and stock assets) remain subject to their own licenses. You represent that you own or have the rights to all content and materials you provide, and you grant us the license needed to perform the work. Unless you ask us otherwise in writing, we may reference and display completed work in our portfolio and marketing.
12. Indemnification
You agree to defend, indemnify, and hold harmless Brionic Security LLC, its owners, and staff from any claims, damages, losses, and expenses (including reasonable legal fees) arising from your content, your use of our services, your violation of these terms or applicable law, or your infringement of any third-party right.
13. Warranties & disclaimer
This website and our services are provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law. Specific service commitments, if any, are governed by your written service agreement.
14. Limitation of liability
To the fullest extent permitted by law, Brionic Security LLC and its owners and staff will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or business, arising out of or relating to our services or this website — even if advised of the possibility. Our total aggregate liability for any claim will not exceed the amount you paid us for the specific service giving rise to the claim during the three (3) months before the event. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.
15. Termination
Either party may end an engagement as described in your service agreement or these terms. We may suspend or terminate services immediately for non-payment, abuse, unlawful use, or breach of these terms. Fees for work performed up to termination remain due.
16. Force majeure
We are not responsible for delays or failures caused by events beyond our reasonable control, including outages, hosting or network failures, cyber-attacks, natural disasters, or acts of third parties or government.
17. Governing law & disputes
These terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. The state and federal courts located in Orange County, California will have exclusive jurisdiction. Before starting any formal action, the parties agree to first attempt to resolve the dispute through good-faith informal discussions.
18. Changes to these terms
We may update these terms and plan inclusions from time to time. Material changes affecting active clients will be communicated; continued use of our services or this website after changes take effect constitutes acceptance.
19. Severability & entire agreement
If any provision of these terms is found unenforceable, the remaining provisions stay in full effect. Where you have a signed service agreement with us, that agreement governs the specific services and controls in the event of a conflict with these website terms.
